What is Zina after Marriage?
One important thing we must understand before we discuss anything is its meaning. So, first, we must understand what Zina is after marriage.
In general, we can understand Zina after marriage as a sexual activity carried out by men and women who have never been married. In Islamic legal literacy, Zina after marriage is called الزِّنَا الْمُحْصَنُ.
One important thing we must remember, that Zina after marriage is a very big sin. So, we have to avoid that.
Quran and Hadith About Zina After Marriage
Quran and hadith are primary references for Muslims. In the Quran and hadith, there is an explanation of Zina after marriage. So, before I explain more about it, I will quote the Quran and hadith which are specifically related to our discussion. The goal is that we can understand it well.
Quran on Zina After Marriage
As for the Quran regarding Zina after marriage, what I mean is as follows:
وَمَن لَّمْ يَسْتَطِعْ مِنكُمْ طَوْلًا أَن يَنكِحَ الْمُحْصَنَاتِ الْمُؤْمِنَاتِ فَمِن مَّا مَلَكَتْ أَيْمَانُكُم مِّن فَتَيَاتِكُمُ الْمُؤْمِنَاتِ ۚ وَاللَّهُ أَعْلَمُ بِإِيمَانِكُم ۚ بَعْضُكُم مِّن بَعْضٍ ۚ فَانكِحُوهُنَّ بِإِذْنِ أَهْلِهِنَّ وَآتُوهُنَّ أُجُورَهُنَّ بِالْمَعْرُوفِ مُحْصَنَاتٍ غَيْرَ مُسَافِحَاتٍ وَلَا مُتَّخِذَاتِ أَخْدَانٍ ۚ فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ ۚ ذَٰلِكَ لِمَنْ خَشِيَ الْعَنَتَ مِنكُمْ ۚ وَأَن تَصْبِرُوا خَيْرٌ لَّكُمْ ۗ وَاللَّهُ غَفُورٌ رَّحِيمٌ
And whoever among you is unable to marry free believing women, then he may marry believing women from the slaves you have. Allah knows your faith: as from you from some of the others, therefore marry them with the permission of their masters, and give them a proper dowry, while they are women who take care of themselves, not people who commit adultery and not women who take other men as pets: and if they have provided themselves with marriage, then they commit a small act (zina), then they must be punished half the punishment of free women who have husbands. That is for those who are afraid that there will be difficulties in guarding themselves (from adultery) among you. And patience is more for you, And Allah is Forgiving, Most Merciful.” (An-Nisa: 25).
Hadith on Zina After Marriage
As for the hadith about Zina after marriage, what I mean is as follows:
وَعَنْ أَبِي هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ قَالَ : أَتَى رَجُلٌ مِنَ الْمُسْلِمِينَ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنِّي زَنَيْتُ ، فَأَعْرَضَ عَنْهُ ، فَتَنَحَّى تِلْقَاءَ وَجْهِهِ فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنِّي زَنَيْتُ ، فَأَعْرَضَ عَنْهُ ، حَتَّى ثَنَّى ذَلِكَ عَلَيْهِ أَرْبَعَ مَرَّاتٍ ، فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ : أَبِكَ جُنُونٌ ؟ قَالَ : لَا ، قَالَ : فَهَلْ أَحْصَنْتَ ؟ قَالَ : نَعَمْ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : اذْهَبُوا بِهِ فَارْجُمُوهُ . مُتَّفَقٌ عَلَيْهِ
From Abu Hurairah radliyallahu anhu, he said, “There was a Muslim who once came to the Messenger of Allah (Prophet Muhammad) sallallahu alayhi wa sallam while he was in the mosque. The Muslim then called him, “O Messenger of Allah, indeed I have committed Zina.” He then turned away from the Muslim. He then looked away from the person’s face. The person then said, “O Messenger of Allah, indeed I have committed Zina.” He then turned away from the person. This incident was repeated four times. When that person had testified for himself four times, Allah’s Messenger then called him and asked, “Are you crazy?” The person said, “No”. He then asked, “Are you married?” The person said, “Yes.” Allah’s Messenger sallallahu alayhi wa sallam then said, “Go with him and lash him.” This hadith was narrated by al-Bukhari and Muslim.
Punishment for Zina After Marriage
Now I will explain the punishment for Zina after Marriage. If we understand the Quran and the hadith about Zina after marriage as I explained earlier, then we can conclude that the punishment for Zina after marriage is lashing to death.
One important thing that we must understand is that the punishment of lashing to death for people who have committed Zina after marriage can only be carried out in areas or countries that do use Islamic law. So, the punishment cannot be carried out in areas or countries that do not use Islamic law. Islamic law I mean here is Islamic law as a whole as Islamic law at the time of the Prophet Muhammad and some period after that.
