One: that the husband who gives talaq is a mature husband, aware that it is talaq, and is not forced (unless the one who compels is a court).

Two: the divorced wife in a chaste condition and not after sex.

So, if you ask me, “what is valid talaq?”, the answer is talaq that fulfills these two conditions. Specifically, valid talaq is talaq given by a husband who is mature, aware that it is talaq, and is not forced to give talaq (unless the court forces it), to his wife who is not menstruating and not after sex.

What Is Invalid Talaq?

The second important point about “when talaq is not valid in Islam?” what I will explain now is “what is invalid talaq?”. I want you to understand that because that is one of the important things about this discussion that must be well understood.

In the previous discussion, I have explained that “valid talaq” is talaq that fulfills two conditions of talaq. So, if you ask me, “what is invalid talaq?”, the answer is talaq that does not meet the two conditions of talaq.

Specifically, invalid talaq is talaq given by a husband who is not yet mature, or is not aware that it is talaq, or is forced to give talaq (unless the court forces it), to his wife who is menstruating or after sex.
