Three Important Things About Adultery (Zina)

Hi all readers! In some of the previous articles, I have explained about bathing after Adultery (Zina). Specifically, in the article, I explained one of the repentant ways to wash away sins because of Adultery. In this article I will explain about three important things about Adultery (Zina); the definition of Adultery (Zina), arguments about the prohibition of Adultery, and the consequences of Adultery (Zina) according to Islam. Of course, as Muslims, we must know that. That’s why I wrote this article. So, you have to read it to the end!

Definition of Adultery (Zina)

One of the basic things about Adultery (Zina) that we must know is the definition of Adultery (Zina). Why is that? Of course, the reason is so that we know what is meant by Adultery (Zina) as one of the great sins that should not be committed by someone, especially Muslims. With that knowledge, we will be able to distinguish whether what we do is included in the category of Adultery (Zina) or not.

If we examine the explanation of Islamic law about Adultery (Zina), then we will find lots of definitions about it. But all the definitions of Adultery (Zina) that I met led to one conclusion, that Adultery (Zina) is sex that is carried out without a legal marriage according to Islam, whether it is done by inserting the penis into the front hole (vagina) or back hole (anus).

Maybe one of you is wondering, “Is putting some of the penis in the front hole or back hole including Adultery (Zina), if it is done without a legal marriage according to Islam?”

We can find answers to these questions in the definition of Adultery according to the Shafi’i sect. According to them, that Adultery (Zina) is inserting the tip of the penis or part of the tip of the penis into the vagina of a woman who is not his wife or slave girl.

Argument About Prohibition of Adultery (Zina)

After we know about the definition of Adultery (Zina) and what is meant by Adultery (Zina), the second point we must know is the argument about the prohibition of Adultery. Actually, we can find this explanation in many verses of the Quran and the hadith of the Prophet Muhammad, as below;

قُلۡ تَعَالَوۡاْ أَتۡلُ مَا حَرَّمَ رَبُّكُمۡ عَلَيۡكُمۡۖ أَلَّا تُشۡرِكُواْ بِهِۦ شَيۡيْأً وَبِٱلۡوَٰلِدَيۡنِ إِحۡسَٰنٗاۖ وَلَا تَقۡتُلُوٓاْ أَوۡلَٰدَكُم مِّنۡ إِمۡلَٰقٖ نَّحۡنُ نَرۡزُقُكُمۡ وَإِيَّاهُمۡۖ وَلَا تَقۡرَبُواْ ٱلۡفَوَٰحِشَ مَا ظَهَرَ مِنۡهَا وَمَا بَطَنَۖ وَلَا تَقۡتُلُواْ ٱلنَّفۡسَ ٱلَّتِي حَرَّمَ ٱللَّهُ إِلَّا بِٱلۡحَقِّۚ ذَٰلِكُمۡ وَصَّىٰكُم بِهِۦ لَعَلَّكُمۡ تَعۡقِلُونَ ١٥١

Say, “Come, I will recite what your Lord has prohibited to you. [He commands] that you not associate anything with Him, and to parents, good treatment, and do not kill your children out of poverty; We will provide for you and them. And do not approach immoralities – what is apparent of them and what is concealed. And do not kill the soul which Allah has forbidden [to be killed] except by [legal] right. This has He instructed you that you may use reason.” (Al-An’am [6]; 151).

وَلَا تَقۡرَبُواْ ٱلزِّنَىٰٓۖ إِنَّهُۥ كَانَ فَٰحِشَةٗ وَسَآءَ سَبِيلٗا ٣٢

And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way. (Al-Isra’ [17]; 32).

The explanation in the hadith is as follows;

عَنْ أَبِيْ هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ قَالَ : قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : لَا يَزْنِيْ الزَّانِيُّ حِيْنَ يَزْنِيْ وَهُوَ مُؤْمِنٌ , وَلَا يَشْرَبُ الْخَمْرَ حِيْنَ يَشْرَبُ وَهُوَ مُؤْمِنٌ , وَلَا يَسْرِقُ حِيْنَ يَسْرِقُ وَهُوَ مُؤْمِنٌ , وَلَا يَنْتَهِبُ نَهْبَةً يَرْفَعُ النَّاسَ إِلَيْهِ فِيْهَا أَبْصَارَهُمْ حِيْنَ يَنْتَهِبُهَا وَهُوَ مُؤْمِنٌ

From Abu Hurairah radliyallahu anhu, he said, “The Prophet (Muhammad) sallallahu alayhi wa sallam said,” Will not commit adultery, someone who when committing adultery (Zina), in a state of faith. Will not drink Khamr (drink that can make you drunk), someone who when drinking Khamr, in a state of faith. The act of stealing, someone who when stealing, is in a state of faith. Will not seize valuables so people see him, someone who seizes valuables, in a state of faith.”

The essence of the hadith above is that when someone is committing Adultery (Zina), then he is not in a state of faith. In other words, adultery is one of the most prohibited acts in Islam.

Consequences of Adultery (Zina) According to Islam

If we read the historical data of Islam about the consequences of Adultery (Zina), we will find that there are two stages used by Islam to prohibit Muslims from committing Adultery (Zina);

First; A person who has been proven to have committed adultery (Zina) will be locked up to death or Allah will make another decision regarding that person.

We can find an explanation about that in the Qur’anic verse below;

وَٱلَّٰتِي يَأۡتِينَ ٱلۡفَٰحِشَةَ مِن نِّسَآئِكُمۡ فَٱسۡتَشۡهِدُواْ عَلَيۡهِنَّ أَرۡبَعَةٗ مِّنكُمۡۖ فَإِن شَهِدُواْ فَأَمۡسِكُوهُنَّ فِي ٱلۡبُيُوتِ حَتَّىٰ يَتَوَفَّىٰهُنَّ ٱلۡمَوۡتُ أَوۡ يَجۡعَلَ ٱللَّهُ لَهُنَّ سَبِيلٗا ١٥

Those who commit unlawful sexual intercourse of your women – bring against them four [witnesses] from among you. And if they testify, confine the guilty women to houses until death takes them or Allah ordains for them [another] way. (An-Nisa’ [4]; 15).

Second; People who have been legally proven to have committed Adultery (Zina) will be flogged up to a hundred times.

We can find an explanation about that in the Qur’anic verse below;

ٱلزَّانِيَةُ وَٱلزَّانِي فَٱجۡلِدُواْ كُلَّ وَٰحِدٖ مِّنۡهُمَا مِاْئَةَ جَلۡدَةٖۖ وَلَا تَأۡخُذۡكُم بِهِمَا رَأۡفَةٞ فِي دِينِ ٱللَّهِ إِن كُنتُمۡ تُؤۡمِنُونَ بِٱللَّهِ وَٱلۡيَوۡمِ ٱلۡأٓخِرِۖ وَلۡيَشۡهَدۡ عَذَابَهُمَا طَآئِفَةٞ مِّنَ ٱلۡمُؤۡمِنِينَ ٢

The [unmarried] woman or [unmarried] man found guilty of sexual intercourse – lash each one of them with a hundred lashes, and do not be taken by pity for them in the religion of Allah, if you should believe in Allah and the Last Day. And let a group of the believers witness their punishment. (An-Nur [24]; 2).

There is one important thing I want to explain related to the consequences of Adultery (Zina) according to Islam, that the caning for those who have committed Adultery (Zina) cannot be applied in the context of the time. The reason is because the state has its own laws for that. If a caning sentence is applied in the current context, it will collide with the applicable state law, unless the state allows it.
