The Fines for People Who Have Sex with His Wife who Is Menstrual ~ Hi all readers! In a number of previous articles, I have explained, that Muslim women who are menstruating should not have sex. She and her husband are only allowed to do foreplay. But what if they both have sex? What is the view of Islam about that? That is what we will discuss in this article.

As before, before I speak further, I will quote the hadith which is specifically related to our discussion.

Hadith About the Fines for People Who Have Sex with His Wife who Is Menstrual

The hadith about the fines for people who have sex with his wife who is menstrual that I mean is as follows;

عَنْ اِبْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا عَنْ رَسُوْلِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِيْ الَّذِيْ يَأْتِيْ امْرَأَتَهُ وَهِيَ حَائِضٌ ، قَالَ ؛ يَتَصَدَّقُ بِدِيْنَارٍ أَوْ بِنِصْفِ دِيْنَارٍ . رَوَاهُ الْخَمْسَةُ

From Ibn Abbas radliyallaahu anhumaa, from the Messenger of Allah sallallaahu alaihi wa sallam, about a person who has sex with his wife who is menstruating. He said, “He is recommended to give alms as much as one Dinar or half Dinar.” The hadith is narrated by five people (Ahmad, Abu Daud, at-Tirmidhi, an-Nasa’i, Ibn Majah).

All readers! The hadith above explains what should be done by someone who is forced to have sex with his wife who is menstruating. But there are differences of opinion among Islamic law experts on this issue;

One; According to Ash-Shafi’i and Ahmad, people who have sex with their menstruating wives are encouraged to give one or half dinars.

Two; According to Malik and Abu Hanifah, the person was not obliged to give alms, but he had to ask Allah for forgiveness (reading istighfar) because he had done it.
