Punishment Because of Eating or Drinking in Ramadan ~ Hi all! For example, “In the afternoon of Ramadan, we do not accidentally eat or drink. We do that because we think that the sun has set, when in fact the sun hasn’t set. It means, we think that we are allowed to eat and drink. The question is, how do we respond to that incident? “

Hadith About Punishment Because of Eating or Drinking in Ramadan

The hadith about eating or drinking in Ramadan that I mean is as follows:

عَنْ هِشَامٍ بْنِ عُرْوَةَ عَنْ فَاطِمَةَ عَنْ أَسْمَاءَ بِنْتِ أَبِيْ بَكْرٍ رَضِيَ اللهُ عَنْهُمَا قَالَتْ : أَفْطَرْنَا عَلَى عَهْدِ رَسُوْلِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَوْمَ غَيْمٍ ثُمَّ طَلَعَتْ الشَّمْسُ . قِيْلَ لِهِشَامٍ : فَأُمِرُوْا بِالْقَضَاءِ ؟ قَالَ : بُدَّ مِنْ قَضَاءٍ

From Hisham bin ‘Urwah from Fatima from Asma bint bint Bakr Radliyalla anhum, she said, “At the time of the Messenger of Allah sallallahu alaihi wa sallam we had eaten when it was cloudy then the sun appeared.” Asked Hisham, ” Are they told to change fasting?” He replied, “[They] have to change fasting.”

If we pay attention to the historical data above, then we know, that if we practice such an event, then we break our fast and we are required to replace it after the month of Ramadan.

Ibn Qudamah said, “If he has eaten because he thinks or believes that time is night but it turns out that it is afternoon, whether it happens at the beginning of fasting or at the end of fasting, then he must change his fast, because Allah has commanded to perfect fasting, but he didn’t perfect it …” He said, “This is the opinion of the majority of Islamic law experts and others.”

Al-Kharqi said, “If he has eaten because he thinks that dawn has not yet appeared even though it has appeared, or he has eaten because he thinks the sun has set when it has not yet set, then he must change his fast.”

The important point that we must pay attention to regarding this topic is that people who experience such events do not pray. That is because he did what he did based on his expectations or beliefs, even though it turned out to be wrong.

Another question is, what if we do it because we forget?

If we do that because we forget, then we must continue our fasting; our fast is not canceled.

What if there is a married couple who has sex in such conditions; they both mistakenly thought the sun had set and they both had sex?

We can find the answer to the question above in the opinion expressed by Ibn Taimiyah. He said, “That if a husband and wife who have sex in such conditions, then they both have to change their fasts and both of them also have to pay a fine for sex during the afternoon of Ramadan.” I will explain the fines to be paid because of having sex during the afternoon of Ramadan in the next article, Allah willing.
