Common Arguments About Abortion According to Islam
All Islamic laws agree that abortion must not be performed after the spirit has inserted into the body of a fetus that is in the womb of a woman. According to Islam, Allah will insert the spirit into the fetus after the fetus is one hundred and twenty days old. If a woman has an abortion after the fetus is one hundred and twenty days old, then she and everyone involved in the act is killing a life. Allah says;
قُلۡ تَعَالَوۡاْ أَتۡلُ مَا حَرَّمَ رَبُّكُمۡ عَلَيۡكُمۡۖ أَلَّا تُشۡرِكُواْ بِهِۦ شَيْأً وَبِٱلۡوَٰلِدَيۡنِ إِحۡسَٰنٗاۖ وَلَا تَقۡتُلُوٓاْ أَوۡلَٰدَكُم مِّنۡ إِمۡلَٰقٖ نَّحۡنُ نَرۡزُقُكُمۡ وَإِيَّاهُمۡۖ وَلَا تَقۡرَبُواْ ٱلۡفَوَٰحِشَ مَا ظَهَرَ مِنۡهَا وَمَا بَطَنَۖ وَلَا تَقۡتُلُواْ ٱلنَّفۡسَ ٱلَّتِي حَرَّمَ ٱللَّهُ إِلَّا بِٱلۡحَقِّۚ ذَٰلِكُمۡ وَصَّىٰكُم بِهِۦ لَعَلَّكُمۡ تَعۡقِلُونَ ١٥١
Say, “Come, I will recite what your Lord has prohibited to you. [He commands] that you do not associate anything with Him, and to parents, good treatment, and do not kill your children out of poverty; We will provide for you and them. And do not approach immoralities – what is apparent of them and what is concealed. And do not kill the soul which Allah has forbidden [to be killed] except by [legal] right. This has He instructed you that you may use reason. ” (Al-An’am ; 151).
Differences of Opinion About the Legality of Abortion Before One Hundred and Twenty Days
Islamic jurists differ on the legality of abortion before one hundred and twenty days. The summary of these differences of opinion is as follows;
The Hanafiyah sect said that abortion can be done before the fetus has a spirit, before one hundred and twenty days. This means that if the fetus is one hundred and twenty days old, then abortion should not be performed.
The Malikiyah sect and the Syafiiyah sect, have two opinions. First, abortion should not be performed after sexual intercourse has occurred. That is, when a man’s sperm has been mixed with a woman’s sperm, then there should not be any attempt to thwart a pregnancy. Second, abortion may be performed before the fetus has a spirit, before one hundred and twenty days.
The majority of Islamic jurists from the Hanabilah sect say that abortion can be done before the fetus has a spirit, before one hundred and twenty days.
